WinMerge je odprtokodni program pod Splošno javno licenco GNU.

To pomeni, da lahko vsakdo prenese izvorno kodo ter jo izboljša in spremeni. Edino, kar zahtevamo je, da nam ljudje svoje izboljšave in modifikacije pošljejo nazaj, tako da bodo imeli koristi vsi uporabniki WinMerge.
